AlldocumentsrelatingtothetenderandanycorrespondenceshallbeintheEnglishlanguage.

Thetendersubmittedbythetenderershallcomprisethefollowing:

(1)TheseInstructionstoTenderers,FormsofTender,ConditionsofContract,AppendixtoconditionsofContractandSpecifications;

(2)TenderSecurity;

(3)PricedBillsofQuantities;

(4)QualificationInformationFormandDocuments;

(5)Alternativeofferswhereinvited;and

(6)Anyothermaterialsrequiredtobecompletedandsubmittedbythetenderers.

ThetenderershallfillinratesandpricesforallitemsoftheWorksdescribedintheBillsofQuantities.ItemsforwhichnorateorpriceisenteredbythetendererwillnotbepaidforseparatelywhenexecutedbutshallbedeemedcoveredbytheotherratesandpricesintheBillsofQuantities.Allduties,taxes,andotherleviespayablebytheContractorundertheContract,orforanyothercauserelevanttotheContract,asof30dayspriortothedeadlineforsubmissionoftenders,shallbeincludedinthetenderpricesubmittedbythetenderer.

TheratesandpricesquotedbythetenderershallonlybesubjecttoadjustmentduringtheperformanceoftheContractifprovidedforintheAppendixtoConditionsofContractandprovisionsmadeintheConditionsofContract.

TheunitratesandpricesshallbeinKenyaShillings.

Tendersshallremainvalidforaperiodof120daysfromthedateofsubmission.Howeverinexceptionalcircumstances,theEmployermayrequestthatthetenderersextendtheperiodofvalidityforaspecifiedadditionalperiod.Therequestandthetenderers’responsesshallbemadeinwriting.AtenderermayrefusetherequestwithoutforfeitingtheTenderSecurity.Atendereragreeingtotherequestwillnotberequiredorpermittedtootherwisemodifythetender,butwillberequiredtoextendthevalidityofTenderSecurityfortheperiodoftheextension,andincompliancewithClause3.7-3.11inallrespects.
